This Privacy Policy is to inform you, the user, in a clear, precise and concise manner. If you accept the Privacy Policy, you will be giving us your free, specific, unequivocal and informed consent for NM type to process your personal data, pursuant to Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (‘GDPR’) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights (‘LOPDGDD’), which constitute the current European and Spanish law on data protection.

1. Privacy Policy

1.1. Basic information on data protection

Purposes of the processing: Answering queries and questions, providing the service and potentially sending information on products and services.

Legitimisation: Consent of the data subject (Article 6(1)(a) of the GDPR). Contractual relationship with the data subject (Article 6(1)(b) of the GDPR).

Recipients: No data will be disclosed to any third parties. The following parties may have access to the data: tax agencies, banks and financial entities, law enforcement agencies and processors, as required for the provision of the service.

Rights and additional information: The exercise of the rights of access, correction or erasure, among others, is allowed. All the information is available in the ‘Detailed information’ section of this Privacy Policy.

1.2.2. What user information do we compile and process through the website?

The data collected are included in the category of identification data, such as the following: name and surnames, telephone, postal address, company, tax identification number, email address and the IP address from which the data collection form is accessed. Also, if a purchase is made, the data required to process the payment will be requested.

When you wish to make a purchase, you must first select the products or services you want to buy and fill in the necessary data to complete your purchase. These data are necessary for us to send you the product or perform the service.

If you provide us with a third party’s data, you will assume the responsibility to have previously informed such third party and to have their consent to provide us with their data, in accordance with Article 14 of the GDPR.

1.2.3. For what purposes do we process the user’s personal data?

NM type processes personal data for the purposes described below, depending on the reason for which the data have been submitted:

  1. To provide the products or services contracted, maintain the contractual relationship and follow up on it.
  2. To contact the client and process, manage and respond to the client’s requests, demands, incidents or queries (either by email or by phone).
  3. To manage the client’s purchase process and any queries associated with the products or services contracted.
  4. To manage the submission of information about products, services and news associated with NM type by electronic and/or conventional means, if appropriate.

1.2.4. What is the legitimisation for the processing of the user’s data?

The legal basis for the processing of the user’s personal data for the purposes described in the above section is the performance of the relevant service, and it is an imperative obligation for it, as established in Article 6(1)(b) of the GDPR.

With regard to the submission of information about products, services and news associated with NM type, the legal basis for the processing of the personal data provided is the consent the user expressly gives, as established in Article 6(1)(a) of the GDPR.

1.2.5. How long will the user’s data be processed?

The data necessary to manage our relationship with the client, invoice them for the services and collect the payment will be kept for as long as the contract is in force. Once this relationship has ended, if appropriate, the data may be kept for the periods required under the applicable law and until any potential responsibilities that result from the contract have expired.

The data for the management of queries and requests will be kept for as long as necessary to respond to such queries and requests and, if appropriate, while the data subject does not request to withdraw their consent to be sent information regarding their query.

The data for the submission of information associated with NM type products or services will be kept while the user does not withdraw their consent.

1.2.6. What recipients will the user’s personal data be disclosed to?

As a general rule, the user’s data will not be communicated to any third parties unless there is a legal obligation for it or this is necessary to perform the service. Bearing this in mind:

In both cases, you must provide proof of your identity by attaching a photocopy or, where appropriate, a scanned copy of your ID or an equivalent document so that we can verify that we will only give an answer to the data subject or their legal representative. In the latter case, you must provide a document attesting such representation.

Additionally, and especially if you believe that you have not obtained full satisfaction in the exercise of your rights, we inform you that you may file a complaint with the national supervisory authority by contacting the Agencia Española de Protección de Datos (Spanish Data Protection Agency, AEPD), C/ Jorge Juan, 6, 28001 Madrid (www.aepd.es).

1.2.8. What security measures have we implemented?

We at NM type are committed to protecting your personal information.

We use physical, organisational and technological measures, controls and procedures, reasonably reliable and effective, aimed at preserving the integrity and security of your data and guaranteeing your privacy.

In addition, all personnel with access to personal data have been trained and are aware of their obligations in relation to the processing of your personal data.

In the case of the contracts that we sign with our suppliers, we include clauses in which they are required to maintain the duty of secrecy regarding the personal data to which they have had access by virtue of the job assigned to them, as well as to implement any technical and organisational security measures that are necessary to guarantee the permanent confidentiality, integrity, availability and resilience of the systems and services for processing personal data.

All these security measures are periodically reviewed to ensure their adequacy and effectiveness.

However, absolute security cannot be guaranteed and there is no security system that is impenetrable. Therefore, in the event that any information that is processed and under our control were compromised as a result of a security breach, we will take appropriate measures to investigate the incident and notify the supervisory authority and, where appropriate, those users who may have been affected so that they will take appropriate measures.

1.2.9. Policy on social networks

NM type has corporate profiles on the social networks Instagram, Twitter, Behance and LinkedIn.

Therefore, NM type is the ‘processor of your data’ by virtue of the existence of those social network profiles and when you follow us, by virtue of which we may also follow you.

The above means that if you choose to join our corporate profile as a follower or by giving a ‘Like’ to our contents or our profile, you will be accepting this Policy, in which we explain your rights and how we use your data.

In our capacity as data processors, we guarantee the confidentiality of the processing and compliance with your rights, always under the data protection law in force.

Also, we inform you that we will use these social networks to announce any news or relevant information in relation to the services we offer, or about issues that we believe may be of interest to you. By using the functionalities of those platforms, you may receive news with this type of information on your wall or in your profile.

However, we also inform you that there is no link between NM type and those platforms or social networks, so you will be accepting their use policy and their terms and conditions once you access those platforms or social networks and/or validate their notices and terms and conditions during the registration procedure. NM type is not responsible for any use or processing of your data beyond the strict relationship and the strict performance of the services indicated in this Policy.

Our website does not use any kind of cookies.

NM type may amend this legal text in accordance with the applicable law from time to time. In any event, any material amendment to the Privacy Policy that affects the use of the website will be duly notified to the user so that they are informed of the changes made to the processing of their personal data and, if the applicable law so requires, the user may give their consent.
