End User Licence Agreement

IMPORTANT! Please read this document carefully and keep a copy for further reference.

This End User Licence Agreement (EULA) is a legal contract between you (the licensee) and NM type (Noel Pretorius and María Ramos Silva). It is applicable to the Font Software that accompanies this document.

By downloading, installing and/or using this Font Software, you acknowledge that you understand this agreement and accept its terms.

It is important to mention that “Font Software” refers here to the software that generates the fonts but also to the design of the typefaces (Typeface Design).

1. Licence and usage rights

1.1. Number of users

Upon payment of the usage fee, you have the non-exclusive right to install and use the font software on a number of computers or other electronic devices within your organisation as determined by your purchase document.

This Font Software is restricted to one organisation. If the Font Software is used by several organisations, each one must purchase a separate licence.

By giving access to this Font Software to other users who may be included in this licence, you confirm that they also agree to the terms of this EULA.

The number of output devices (printers) is not restricted.

1.2. Embedding

For the purpose of providing documents to printers or other suppliers for reproduction, you can embed the font software in PDF documents. These PDF documents for reproduction can only allow for the viewing and printing of text. They must be non-editable. In order to provide the correct rendering of text on reading devices, e-book embedding is also allowed.

You can create and share rasterised representations of the Font Software in bitmap file formats (e.g. gif, png or jpg).

1.3. Type of licence

The type of licence or licences you have acquired are defined in your purchase document. The rights of use of the Font Software depend on the type of licence you have acquired.

A – Desktop licence

You may install and use the Font Software on a limited number of computing devices as stated in your purchase document. You can use the Font Software for professional and personal projects, web images, PDF embedding and e-book embedding.

B – Web licence

You may use the Font Software for web embedding in one or several sites, up to the traffic limit stated in your purchase document. If at any time the traffic of the sites that use the Font Software exceeds the limit of your licence, you must notify NM type and upgrade your licence.

C – App licence

You may use the Font Software for app embedding in a limited number of apps, as stated in your purchase document.

2. Copyright

Font Software are intellectual property of and are owned by Noel Pretorius and María Ramos Silva (NM type). All the rights are reserved to NM type. You do not gain the ownership of the Font Software under this EULA.

If you use the Font Software in a project that includes design credits, you should also include the name of the Font Software and the name of the authors (Noel Pretorius and María Ramos) which can be abbreviated as “NM type”.

3. Distribution and modification

You are not allowed to give, rent or lease the Font Software or parts of it to a third party. Distribution, loan, sell, or sub-licence of the Font Software is prohibited. You are also responsible to prevent the unauthorised use and distribution of the Font Software. You shall not transfer any of your rights, duties and obligations under this EULA to any person or entity.

The Font Software may not be copied or duplicated in any form except for backup purposes. You are not allowed to modify, adapt, decompile or alter the Font Software. Any modification of the Font Software, including conversion into other formats, requires written consent of NM type. If you infringe this prohibition, all the rights over the modified version of the Font Software will belong to NM type.

4. Updating and upgrading

NM type is not obligated to provide updates of the Font Software. If the Font Software is updated in any way, this may be subject of a new licence.

You can upgrade your licence for a larger use or to a more complete type family at any time. For more information about your specific request please contact NM type providing your order number and your current licence details.

5. Warranties

This Font Software includes a 30-day warranty as a trial period to identify any possible defect in the font files according to the documentation. To make a warranty claim, you have to return the defective Font Software and provide the details of your order within 30 days counting from the date of purchase.

The full warranty for the Font Software provided with your licence extends two years. If you experience any difficulty you can contact us to solve the issues.

NM type cannot warrant the performance or results obtained by using this Font Software. NM type does not warrant that the operation of the Font Software will be uninterrupted or error-free, or that the Font Software is without defects. NM type will not be liable for any damages, claims or costs arising out of any use of, or inability of use, this Font Software.

6. Termination

This licence is perpetual, unless you breach any term of this EULA. In such a case, your licence and rights of use of the Font Software will be immediately invalidated. In the event of termination you must delete the Font Software and any copy you may have.

7. Final provisions

All rights not granted in this document to you are reserved to Noel Pretorius and María Ramos Silva.

This contract is subject to the laws of Sweden and Spain. Typeface Design and Font Software are protected by copyright international laws.
